TERMS AND CONDITIONS OF SALE

- All orders are cash on delivery, unless prior credit approval has been established.

- The invoice for purchased material will accompany the order and will be presented by delivery personnel.

- If prior approved credit has been established, payments are due 30 days from date of invoice.

- A finance charge of 2% per month is applied on all accounts not paid within 30 days of the invoiced date.

- If applicable, H.S.T. is extra.

- Custom-made material cannot be cancelled once ordered and is non-returnable.

- Goods may not be returned without prior written authorization.

- A restocking charge of 15% applies to all returned orders.

- Delivery charge is based on standard delivery days and areas of service. - All pricing in catalogue may change without notice.

JOB SITE DELIVERY

Sheet lengths for job site delivery should not exceed thirty feet. Deliveries are made to the job site and placed within reason, depending on the accessibility of our vehicles and with concern for the customer’s property. Easy Building Products personnel cannot direct material into a building or onto a roof. Hydro wires and overhead objects may present unloading problems.

Job site directions must be clearly stated at time of order. Faxed/Emailed copies are preferred, including the telephone number of the customer and the job site fire number, concession and township.

LIMITS OF LIABILITY

If the product is found defective or does not conform to the terms of the order as accepted by the Seller, the Seller’s sole obligation to the Buyer will be to replace such products as proven defective. The buyer shall promptly notify the Seller of any claim in respect of the product, and such product shall be held for the inspection of the Seller, and shall not have been used or incorporated in any works.

Without limiting the generality of the foregoing, in no event, shall the Seller’s liability exceed the invoice price of the defective products. The Seller shall not be liable for any costs related to labour, construction, delay in construction or any other matter whatsoever and the same shall be the basis of any claim. The Seller’s obligation to replace the product shall apply only if the defect is reported before use of, installation of, and/or erection of the material. This warranty replaces any other warranty, expressed or implied, whether statutory or otherwise.

In no event shall the Seller be liable for Consequential Damages.

LIMITED 40 YEAR WARRANTY
APPLIES TO EBP WARRANTED ROOFING AND SIDING PANELS

The color-coated finish on Easy Building Products panels is produced and applied according to standard application practices set forth by coating suppliers… Akzo Nobel, Dura Coat, and Prosperity. Easy Building Products, warrants that the integrity of the color-coated finish applied to its roofing and siding panels will not, within a period of 40 years after the installation or 40 years and one month after the date of shipment of panels from Easy Building Products, (whichever comes first) under normal atmospheric conditions (which exclude corrosive aggressive chemicals, chemical fumes, or direct contact with certain treated lumber).

1. Peel, crack, check, flake, or blister to an extent that it is apparent on ordinary outdoor visual observation.
    
2. Vertical installations of Easy Building Products panels will not change color more than 5 NBS (Hunter) units, and non-vertical installation will not change more than seven 7 NBS (Hunter) units following field installation. Color measurements are to be made per ASTM D-2244 and only on clean surfaces after removing surface deposits and chalk per ASTM D-3964.
    
3. For (30) years, sidewall panels will not chalk more than a number eight rating, and non-vertical installations will not chalk more than a number six rating, when measured per ASTM D-4214, Method A.

This is an anti-weathering limited warranty and does not apply to other causes of degradation, including:

1. Coating failures caused by scratches, scrapes or any other unnatural damage including improperly formed or fabricated material or used in a manner not originally intended.
    
2. Acts of God including but not limited to, radiation, falling objects, explosions, or other external forces beyond Easy Building Products control.
    
3. Failures caused by standing water / moisture trapped between panels during storage.
    
4. Direct exposure to corrosive and aggressive atmospheres including contact with animals and/or animal waste or its decomposition products.
    
5. Applications exposed to salt spray or within 1000 meters of the sea coast.
    
6. Corrosion of the substrate and/ or corrosion at cut edges; or develops any other condition between the coating and the substrate or delaminate.

This warranty is expressly subject to the following terms and conditions:

1. Easy Building Products responsibility extends only to the direct cost of refinishing or replacing of the warranted products. Easy Building Products will not accept liability for loss or damage to other property or equipment, loss of profits or sales, or any other claims relative to standard business interruption.
    
2. Easy Building Products reserves the right to establish whether refinishing or replacing of the material is required and to approve and participate in the negotiation of any subcontracted material replacement, installation, or refinishing. The replaced or refinished area will be considered as installed as of the original installation date for the purpose of the application of this warranty.
    
3. The expressed warranty stated herein is the exclusive express warranty applicable to the color-coated finish on Easy Building Products panels. Any implied warranties, including any implied warranty or merchantability or fitness for a particular purpose, are limited in duration to the time period of the express warranty set forth herein.
    
4. Claims under this warranty must be made in writing to Easy Building Products at the address set below within 30 days after the discovery of the defect. Easy Building Products shall have an additional 60 days to inspect the claim before any further action shall be taken.
    
5. Defects or damages to the Easy Building Products color-coated finish caused by handling, shipping, transit, processing, storage or installation are not covered by this warranty. This warranty further shall not extend to or cover damage to the warranted color-coating occasioned by moisture or other contamination detrimental to the color-coated metal prior to installation.
    
6. Minor hairline cracking of the color-coated finish is not covered by this warranty.
    
7. The Easy Building Products color-coated finish is not warranted to weather uniformly under non-uniform conditions of exposure or use.
    
8. All claims under this warranty must be accompanied by the original invoice.
    
9. The remedy for any claims arising from a defective color-coated finish on Easy Building Products panels shall be limited to refinishing or replacing the defective panels, or where applicable a refund of purchase price. The amount of refund shall be reduced by 5% for each year the Easy Building Products panels were in use. This beginning after the ninth year.
    
10. THIS WARRANTY IS LIMITED TO THE ORIGINAL PURCHASER ONLY AND IS NOT TRANSFERABLE.
